By using the Pomelo Fitness mobile application or the website www.pomelofitness.com, you agree to the following terms and conditions. Please read them carefully.

1. Acceptance of Terms

By downloading, installing, or using the Pomelo Fitness mobile application (the "App"), or by visiting the website www.pomelofitness.com (the "Website", and together with the App, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Services.

2. User-Generated Content Policy

This App allows users to share content including photos, text, workout logs, recipes, and other materials ("User Content"). You are solely responsible for all User Content you submit.

You agree NOT to post, upload, or share content that:

  • Is objectionable, offensive, or inappropriate
  • Contains hate speech, harassment, bullying, or threats
  • Is sexually explicit or pornographic
  • Promotes violence or self-harm
  • Infringes on intellectual property rights

  • Users who repeatedly violate these Terms may have their accounts suspended or permanently terminated
  • We reserve the right to remove any content at our sole discretion

4. Reporting & Blocking

  • You can report objectionable content or abusive users using the reporting feature
  • You can block users to prevent them from contacting you or seeing your content
  • All reports are reviewed by our moderation team
  • False or malicious reporting may result in account action

5. Account Termination

We reserve the right to suspend or terminate your account at any time if:

  • You violate these Terms of Service
  • You post objectionable or inappropriate content
  • You engage in harassment, abuse, or threatening behavior
  • You attempt to circumvent our moderation systems

6. Fitness and Health Disclaimer

No Medical Advice

Pomelo Fitness is a fitness tracking and social platform. The Services are for informational and social purposes only and are not intended to:

  • Provide medical advice, diagnosis, or treatment
  • Replace professional medical consultation
  • Prescribe fitness or nutrition plans

Always consult with a qualified healthcare provider before:

  • Starting any new exercise program
  • Making significant dietary changes
  • If you have any medical conditions or concerns

If you think you may have a medical emergency, call your local emergency number (911 in the United States) immediately.

Use at Your Own Risk

You acknowledge that:

  • You are responsible for assessing your own fitness level
  • We are not liable for any injuries or health issues resulting from your use of the Services
  • User-generated content may not be accurate or suitable for your needs

No Warranties on User Content

We do not verify the accuracy, completeness, or safety of User Content, including:

  • Workout routines and exercises
  • Nutrition information and recipes
  • Fitness advice from other users

7. Disclaimer of Warranties

The Services are provided "as is" without warranties of any kind. We do not guarantee the accuracy, completeness, or usefulness of any content.

8. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.

9. Intellectual Property & DMCA

We respect intellectual property rights and expect our users and content sources to do the same. The App may feature recipe and workout content adapted from publicly shared social-media posts, credited to the original creator. If you believe content in the App or on the Website infringes your copyright, you may notify our Designated Copyright Agent as described in our Copyright & DMCA Policy, and we will respond in accordance with the Digital Millennium Copyright Act, including expeditiously removing infringing material and terminating repeat infringers. Creators may request removal of their content or attribution at any time via the contact in that Policy.

10. Privacy

Your use of the Services is also governed by our Privacy Policy. By using the Services, you consent to the collection and use of your information as described therein.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Services after changes constitutes acceptance of the updated Terms.
