Copyright & DMCA Policy

Pomelo Fitness ("we," "our," or "us") respects the intellectual property rights of others and expects users and content partners to do the same. This policy explains how to report content in our mobile application Pomelo (the "App") that you believe infringes your copyright, and how we respond, under the Digital Millennium Copyright Act ("DMCA," 17 U.S.C. § 512).
1. Reporting Copyright Infringement (DMCA Notice)
If you are a copyright owner, or authorized to act on behalf of one, and believe that content in the App infringes your copyright, please send a written notice to our Designated Copyright Agent (see Section 4). To be effective, your notice must include substantially all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
- Identification of the copyrighted work you claim has been infringed;
- Identification of the material you claim is infringing, and information reasonably sufficient to let us locate it (for example, the screen, the recipe or routine title, and/or the original creator handle shown in the App);
- Your contact information — name, mailing address, telephone number, and email address;
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law;
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
2. Our Response
Upon receiving a valid notice, we will act expeditiously to remove or disable access to the material, and we may notify the affected user or content source and disable the source account from which the material was obtained.
3. Counter-Notification
If you believe your content was removed or disabled by mistake or misidentification, you may send a written counter-notification to our Designated Agent that includes: your physical or electronic signature; identification of the removed material and the location where it appeared before removal; a statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification; and your name, address, and telephone number, together with a statement that you consent to the jurisdiction of the federal district court for your judicial district (or, if outside the United States, any judicial district in which we may be found) and that you will accept service of process from the party who filed the original notice.
4. Designated Copyright Agent

5. Curated Content & Creator Requests
The App may feature recipe and workout content adapted from publicly shared social-media posts, with attribution to the original creator. If you are a creator and would like your content or its attribution removed, you do not need to file a formal DMCA notice — simply contact us at legal@pomelofitness.com and we will remove it promptly.
6. Repeat Infringers
In appropriate circumstances, we will disable or terminate the accounts and content sources of those who repeatedly infringe the copyrights of others.
7. Misrepresentations
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages.
Pomelo - Fitness Social Media Platform
